When will they learn … or ” am I dreaming?”

It’s been nearly nine months since i described the difference between “from here ” and “come here” people.

At that time, I described the notion that there are people who move to an area with the expectation that they will some how magically make the new land “just the way they want”. Then there are people who move to a place because they like the way it is . The latter try to become apart of the fabric of local life where as the former try to mold the landscape to their will.

I thought I was past those distinctions. I thought I had established myself as someone who wanted to “fit in”. It turns out I wasn’t 100% correct and in need of proving myself.

The LLC (limited liability company) owning the adjacent property to my farm didn’t quite like how things had played out. I bought my land and opted to to have a boundary survey done. Good thing. It turned out the surveyors found an error in the the land description. Thus, the seller made accommodations and the boundary survey was completed and subsequently filed with the county.

The adjacent land buyer was not quite so astute. They bought their land “by description and not actual to acreage”. The result is they *thought* they owned about 17 acres of my land. *WRONG*.

Well, I *thought* we had this issue resolved. I discovered this evening that, while the adjacent land owner had been informed of the error, he thought he could be cheeky and burden someone else with it. The reputable farmer working my land informed me that another farmer was planning to till 15 arces of the newly planted soy beans.

What irks me is not the fact that there is an error. What irks me is the fact that it was addressed and now the abutter is attempting to imply ignorance and take over my land. The irony is that his “eventual plan” is to establish a housing development and that development plan shows where the *correct* land boundary is. Stupidity never ceases to amaze me.

In reality, I will now need to confir with the county. I will need to verify the boundaries are correctly recorded. I will need to inform the adjacent owner and his contract farmer where the boundary is recorded. And, I wil need to insure I am recorded as being in the clear. It’s all unfortunate and a real PITA.

    Congratulations on having a determined, but constructive attitude. From the way you’ve worded your post, it sounds as if you are taking the situation seriously without letting it get to you. Good luck.

    Thanks Mary. The first incident started they way most border disputes occur … no, not with gun fire but with a letter from “his” lawyer to “my” lawyer. Classic. Anyway, at that time, my lawyer looked everything over and we came to the now classic line “you own what you own”. Since my boundary survey is recored with the county and has been since the deed, there is not much debate left.

    I took a look at how the other property ended up being plowed and it lines up just as it should so I’m guessing we’ve maintained the status quo once again.
